Terms of Service

1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the services provided by MotoRinse ("Company," "we," "us," or "our"), including our mobile application, website (motorinse.com), and all related car wash, parking, and digital wallet services (collectively, the "Services").

By registering for an account, downloading our mobile application, or otherwise accessing or using the Services, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

2. Definitions

  • "Service" — The MotoRinse platform including the mobile app, website, car wash scheduling, wallet system, and parking marketplace.
  • "Customer" — A registered user who subscribes to car wash or parking services.
  • "Washer" — A MotoRinse-employed or contracted service staff member who performs car washes.
  • "Admin" — MotoRinse administrative personnel who manage operations.
  • "Wallet" — The prepaid digital wallet associated with a Customer's account.
  • "Subscription" — An active car wash plan linked to a specific vehicle.
  • "Wash Job" — A scheduled car wash task assigned to a Washer for a specific vehicle on a specific date.
  • "Parking Spot" — A parking space listed on the MotoRinse marketplace by a host.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age.
  • Have a valid Indian mobile phone number.
  • Possess a valid vehicle registration (for car wash services).
  • Be a resident or have authorised access to a residential society where MotoRinse operates.
  • Have the legal capacity to enter into a binding contract under Indian law.

By using the Services, you represent and warrant that you meet all eligibility requirements.

4. Account Registration & Security

To access the Services, you must register an account by providing your phone number and creating a password. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your account credentials confidential and not share them with any third party.
  • Be solely responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorised access to or use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

5. Services Offered

MotoRinse provides the following services, subject to availability in your area:

  • Subscription-Based Car Wash — Daily, Alternate Day, or Weekly wash plans with eco-friendly waterless wash technology.
  • Prepaid Digital Wallet — A wallet system for seamless pay-per-wash billing.
  • Vacation Mode — Ability to pause wash services when not needed.
  • Photo Verification — Digital proof of every wash completion.
  • Parking Spot Marketplace — A platform for listing and renting parking spaces within residential societies.
  • Push Notifications — Real-time service alerts and updates.

We reserve the right to modify, suspend, or discontinue any Service (or any part thereof) at any time, with reasonable notice to affected users.

6. Subscription Plans & Pricing

6.1 Pay-Per-Wash Model

MotoRinse operates on a pay-per-wash model. There are no fixed monthly fees. You are charged per wash based on:

  • Your vehicle size (Small / Medium / Large).
  • Your plan frequency (Daily / Alternate / Sunday).

6.2 Pricing

Current pricing is displayed in the app and on our website. Prices are in Indian Rupees (₹) and are inclusive of all applicable taxes unless stated otherwise.

6.3 Price Changes

We reserve the right to modify pricing with a minimum of 15 days' prior notice through the app or email. Continued use of Services after the effective date of a price change constitutes acceptance of the new pricing.

7. Wallet System

  • Top-Up — You may add funds to your wallet via Razorpay (UPI, cards, net banking). Minimum top-up amounts may apply.
  • Deductions — Wallet balance is deducted automatically upon successful completion of each wash job.
  • Overdraft — A small overdraft of up to ₹150 may be permitted to prevent service disruption. If your balance falls below -₹150, new wash jobs will not be scheduled until you add funds.
  • No Interest — Wallet balances do not earn any interest.
  • Non-Transferable — Wallet balances are non-transferable between accounts.
  • Wallet Balance on Termination — See Section 18 (Termination) for details on wallet balance handling upon account closure.

8. Vacation Mode

You may activate Vacation Mode through the app at any time. While Vacation Mode is active:

  • No wash jobs will be scheduled for the vehicle.
  • No wallet deductions will occur.
  • Your subscription remains active and will automatically resume when Vacation Mode is deactivated.

9. Wash Service Terms

  • Scheduling — Wash jobs are automatically generated by our scheduling system based on your subscription plan, vehicle, and wallet balance.
  • Wash Type — We use eco-friendly waterless wash technology. Premium wash options may be available at additional cost.
  • Photo Proof — Every completed wash is verified with a photograph uploaded by the assigned Washer. You can view wash photos in the app.
  • Access Requirement — You must ensure your vehicle is accessible in the designated parking area during the scheduled wash window. MotoRinse is not responsible for missed washes due to inaccessible vehicles.
  • Quality — If you are dissatisfied with the quality of a wash, please report it through the app within 24 hours. We will investigate and, if warranted, provide a re-wash or credit.
  • Vehicle Safety — MotoRinse takes reasonable care while servicing your vehicle. However, we are not liable for pre-existing damage, scratches, or issues not caused by our service.

10. Parking Spot Marketplace

10.1 For Hosts

  • You may list your unused parking spot on the MotoRinse marketplace.
  • You retain 95% of the earnings from your listed spot. MotoRinse retains 5% as a platform fee.
  • You are responsible for ensuring the listed spot is available during the specified times.
  • Listings must be accurate and not misleading.

10.2 For Renters

  • Parking spot availability is subject to host listings and may vary.
  • You must follow all parking rules of the housing society.
  • Check-in is managed through a QR code system.

10.3 Dispute Resolution

Any disputes between hosts and renters should be reported through the app. MotoRinse will mediate but is not responsible for damages arising from the use of third-party parking spots.

11. Payment Terms

  • Payment Gateway — All payments are processed through Razorpay, a PCI DSS-compliant payment gateway. We do not store your card/bank details on our servers.
  • Currency — All transactions are denominated in Indian Rupees (₹).
  • Failed Transactions — If a wallet top-up transaction fails, the amount will not be credited. If the amount is debited from your bank but not reflected in your wallet, please contact us with transaction details for resolution within 5-7 business days.
  • Invoices — Digital transaction records are available in your app under the wallet/transaction history section.

12. Refund & Cancellation Policy

12.1 Subscription Cancellation

You may cancel your subscription at any time through the app. Upon cancellation:

  • No further wash jobs will be scheduled.
  • Any remaining wallet balance can be refunded upon request (see below).

12.2 Wallet Refunds

  • You may request a refund of your unused wallet balance through the app.
  • Refund requests will be reviewed and processed within 7-10 business days.
  • Refunds are initiated via Razorpay to your original payment method.
  • A processing fee may apply for refunds below a certain threshold (if applicable, this will be disclosed at the time of request).

12.3 Service Credits

In cases of proven service failure (e.g., missed wash, poor quality), MotoRinse may, at its discretion, issue wallet credits rather than monetary refunds.

13. User Responsibilities

As a user of MotoRinse, you agree to:

  • Provide accurate vehicle information (model, registration number, size, colour, parking slot).
  • Maintain a sufficient wallet balance for uninterrupted service.
  • Ensure your vehicle is parked and accessible at the designated location during the wash schedule.
  • Use the app and Services only for lawful purposes.
  • Not impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Report any service issues or concerns promptly through the app.

14. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorised access to any part of the Services, servers, or systems.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Upload malicious code, viruses, or harmful content.
  • Harass, abuse, or threaten MotoRinse staff, Washers, or other users.
  • Attempt to reverse-engineer or decompile the app or any part of the Services.
  • Create multiple accounts for fraudulent purposes or to circumvent restrictions.
  • Provide false vehicle registration details or other inaccurate information.

Violation of any of the above may result in immediate account suspension or termination without refund.

15. Intellectual Property

  • The MotoRinse name, logo, brand identity, app design, website content, and all associated intellectual property are owned by MotoRinse and are protected under applicable Indian intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app and Services for personal, non-commercial purposes in accordance with these Terms.
  • User Content — By using the Services, you grant MotoRinse a non-exclusive, royalty-free licence to use wash photos and service-related data for operational and quality assurance purposes.

16. Limitation of Liability

  • The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
  • MotoRinse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
  • Our maximum aggregate liability for any claims arising from or related to the Services shall not exceed the total amount paid by you to MotoRinse in the 12 months preceding the event giving rise to the claim.
  • Force Majeure — We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, government actions, pandemics, internet or telecommunications failures, or power outages.

17. Indemnification

You agree to indemnify, defend, and hold harmless MotoRinse, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with:

  • Your use of or conduct on the Services.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any content you submit or share through the Services.

18. Termination

18.1 By You

You may terminate your account at any time by contacting us or through the app settings. Upon termination:

  • Your active subscriptions will be cancelled.
  • Pending wash jobs will be cancelled.
  • You may request a refund of any positive wallet balance (subject to Section 12).

18.2 By MotoRinse

We may suspend or terminate your account if:

  • You violate these Terms or any applicable law.
  • You engage in prohibited conduct.
  • Your account has been inactive for more than 12 months.
  • We are required to do so by law or government order.

In cases of termination due to violation, any remaining wallet balance may be forfeited.

18.3 Effect of Termination

Upon termination, all licences and rights granted to you under these Terms shall immediately cease. Sections relating to Intellectual Property, Limitation of Liability, Indemnification, and Governing Law shall survive termination.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

20. Dispute Resolution

Before initiating any legal proceedings, the parties shall attempt to resolve disputes amicably through good-faith negotiation. If the dispute is not resolved within 30 days:

  • The dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended).
  • The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties.
  • The seat of arbitration shall be Pune, Maharashtra, India.
  • The language of arbitration shall be English.
  • The arbitrator's award shall be final and binding.

21. Modifications to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 15 days' notice through the app (via push notification), email, or a prominent notice on our website. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must discontinue using the Services.

22. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.
